OVERVIEW

These Terms of Service (“Terms”, “Agreement”) constitute a legally binding agreement between you (“you”, “your”, “customer”, “user”) and BROWSXPERT LLC (“BROWSXPERT”, “COSMETICSXPERT”, “we”, “us”, “our”).

By accessing, browsing, purchasing from, or using our website, online store, services, products, educational materials, or any digital features (collectively, the “Services”), you confirm your acceptance of these Terms and our Privacy Policy.

The Services are hosted by Shopify Inc., which provides the e-commerce platform that enables us to sell our products and operate the website. All purchases made on the website are transactions between you and BROWSXPERT LLC, not Shopify.

If you do not agree with these Terms, you must immediately discontinue use of the Services.

SECTION 1 — ELIGIBILITY, ACCESS & ACCOUNT CREATION

To use the Services, you must:

  • be at least the age of majority in your state or jurisdiction, or

  • have legal consent from a parent or guardian to use the Services.

When creating an account or submitting information, you agree that:

  • all information provided is accurate, complete, and current;

  • you will maintain the confidentiality of your login credentials;

  • you will notify us immediately if you suspect unauthorized access;

  • you will not impersonate any person or use another person’s account.

BROWSXPERT LLC reserves the right to refuse service, disable accounts, limit access, or terminate accounts for violations of these Terms.

SECTION 2 — PRODUCT INFORMATION & PROFESSIONAL USE DISCLAIMER

BROWSXPERT sells cosmetic products, esthetic tools, professional-use items, and digital educational materials. Certain products — including brow henna, mapping tools, pigments, and procedures-related items — may require:

  • proper professional training,

  • applicable state licensure,

  • adherence to sanitation and safety guidelines,

  • patch-testing prior to use.

You acknowledge and agree that:

  • Product results vary and are not guaranteed.

  • Colors, appearance, textures, and packaging may appear differently depending on your device.

  • You are responsible for using products safely and appropriately.

  • You will comply with all professional and regulatory requirements applicable to your practice.

We reserve the right to modify product descriptions, discontinue items, or limit quantities at any time.

SECTION 3 — ORDER ACCEPTANCE & LIMITATIONS

Placing an order constitutes an offer to purchase.
An order is not considered accepted until:

  1. payment is successfully processed, and

  2. BROWSXPERT LLC acknowledges acceptance via email or order confirmation.

We reserve the right to:

  • refuse or cancel any order,

  • limit quantities per customer, household, or account,

  • reject orders placed using false information, fraudulent activity, or reseller intent,

  • cancel orders when items are out of stock, pricing errors occur, or regulations require it.

If an order is canceled, we will notify you using the email or phone number provided at checkout.

All purchases are governed by our Return & Refund Policy.

SECTION 4 — PRICING, BILLING & PAYMENT TERMS

All prices are listed in U.S. Dollars unless otherwise stated. Prices may change at any time without notice.

Unless explicitly stated, prices do not include:

  • sales tax,

  • VAT,

  • customs duties,

  • shipping fees,

  • import charges.

You authorize BROWSXPERT LLC to charge your selected payment method for all purchases and associated fees.

You represent and warrant that:

  • the payment information provided belongs to you;

  • you are authorized to use the payment method;

  • all charges will be honored by your financial institution;

  • you will update your payment information as needed.

Fraudulent orders will be reported and prosecuted.

SECTION 5 — SHIPPING, DELIVERY & RISK OF LOSS

Shipping times are estimates only and are not guaranteed. Once an order is transferred to the carrier:

  • risk of loss and title pass to the customer;

  • BROWSXPERT is no longer responsible for lost, stolen, delayed, or damaged packages.

International orders may be subject to customs inspections, import duties, taxes, or delays, which are solely the customer’s responsibility.

We do not guarantee delivery dates or carrier performance.

SECTION 6 — INTELLECTUAL PROPERTY RIGHTS

All content on the Services — including trademarks, brand names (“BROWSXPERT”, “COSMETICSXPERT”), product names, logos, designs, graphics, educational materials, downloadable content, images, videos, and text — are the exclusive property of BROWSXPERT LLC unless otherwise stated.

You may not:

  • copy, reproduce, modify, display, publish, distribute, translate, or create derivative works;

  • use our trademarks without written authorization;

  • exploit any part of the Services for commercial purposes.

Violations may result in legal action under U.S. intellectual property law.

SECTION 7 — OPTIONAL THIRD-PARTY TOOLS

We may provide access to third-party apps, analytics systems, fulfillment partners, or optional tools (e.g., payment providers, marketing apps).

You acknowledge that we:

  • do not monitor or control these third parties,

  • provide them “as is” and “as available,”

  • are not liable for any damages arising from their use.

Your use of third-party tools is at your own risk.

SECTION 8 — THIRD-PARTY LINKS & EXTERNAL SITES

The Services may include external links. BROWSXPERT LLC is not responsible for:

  • the accuracy of third-party content,

  • products or services offered by third parties,

  • privacy practices of external websites.

Accessing third-party sites is at your sole risk.

SECTION 9 — SHOPIFY RELATIONSHIP DISCLOSURE

The website is powered by Shopify. Shopify:

  • does not handle your transaction with BROWSXPERT LLC,

  • does not provide warranties for our products,

  • is not responsible for any disputes regarding purchases, returns, safety, or product claims.

You expressly release Shopify from any claims arising from your use of BROWSXPERT’s Services.

SECTION 10 — PRIVACY POLICY

All personal information collected is subject to:

  • BROWSXPERT LLC Privacy Policy, and

  • Shopify’s Privacy Policy, since Shopify hosts our website.

Your data may be processed in the United States or internationally.
You agree to review the Privacy Policy before using the Services.

SECTION 11 — FEEDBACK, REVIEWS & SUBMISSIONS

Any feedback, reviews, images, suggestions, or submissions provided by you may be used by BROWSXPERT LLC for commercial purposes under a perpetual, worldwide, royalty-free license.

You represent that:

  • you own the rights to the content,

  • your review is honest and voluntary,

  • your submission does not infringe on third-party rights.

We may remove content that violates these Terms or applicable laws.

SECTION 12 — ERRORS, INACCURACIES & CORRECTIONS

Occasionally the Services may contain typographical errors, omissions, or inaccuracies. We reserve the right to:

  • correct errors,

  • update information,

  • cancel orders due to incorrect information.

SECTION 13 — PROHIBITED USES

You agree not to use the Services for:

  • unlawful, fraudulent, or harmful purposes;

  • violating laws or infringing rights;

  • distributing malware or harmful code;

  • data scraping or unauthorized data collection;

  • attempting to gain unauthorized access to systems;

  • harassment, abuse, or defamation of individuals or staff.

Violation may result in immediate termination.

We may suspend or terminate your access at any time for any violation of these Terms. All obligations incurred prior to termination remain enforceable.

SECTION 15 — DISCLAIMER OF WARRANTIES

Except where prohibited by law, all products and services are provided “as is”, “as available”, without warranties of any kind, including:

  • merchantability,

  • fitness for a particular purpose,

  • durability,

  • non-infringement,

  • uninterrupted or error-free operation.

Use of cosmetic and esthetic products involves inherent risks. You assume all such risks.

SECTION 16 — LIMITATION OF LIABILITY

To the maximum extent permitted by law, BROWSXPERT LLC shall not be liable for:

  • indirect, incidental, punitive, or consequential damages,

  • lost revenue, lost profits, or loss of data,

  • injuries resulting from improper product use, allergic reactions, or negligence,

  • delays, shipping issues, or carrier-related problems.

Your sole remedy is discontinuing use of the Services.

SECTION 17 — INDEMNIFICATION

You agree to indemnify and hold harmless BROWSXPERT LLC, COSMETICSXPERT, Shopify, and their affiliates from any claims arising out of your:

  • misuse of products,

  • use of the Services,

  • violation of these Terms,

  • breach of rights of a third party.

SECTION 18 — SEVERABILITY

If any provision is unlawful or unenforceable, the remaining provisions remain valid.

SECTION 19 — WAIVER & ENTIRE AGREEMENT

Failure to enforce rights does not waive them.
These Terms constitute the complete agreement between you and BROWSXPERT LLC.

SECTION 20 — ASSIGNMENT

You may not transfer your rights without our consent.
We may assign this Agreement at any time.

SECTION 21 — GOVERNING LAW

These Terms are governed by the laws of the State of Florida, USA.
You agree to submit to the exclusive jurisdiction of courts in Florida.

SECTION 22 — CHANGES TO TERMS

We reserve the right to update or modify these Terms at any time.
Continued use of the Services constitutes acceptance of updated Terms.
